The Ancient Chinese Lunar Calendar

Before their adoption of the Western solar calendar system, the Chinese almost wholly followed their own lunar calendar for working out the times of planting and harvesting and festival days. Although people in China today use the Western calendar for almost all business, governmental and practical matters of daily life, the old arrangement still serves as the basis for determining many recurring holidays. This coexistence of two calendar schemes has long been acknowledged by the people of China.

However, this does not only apply to China, it also occurs in most other Eastern countries, like Thailand, and most Arabic countries.

A lunar month is determined by measuring the period of time needed for the moon to complete its full cycle of 29 and a half days, a standard that makes the lunar year a whole eleven days shorter than its solar counterpart. This difference is made up every 19 years by the addition of seven lunar months.

The 12 lunar months are further divided into 24 solar divisions characterized by the four seasons and times of heat and cold, all of which bear a close relationship to the yearly cycle of agricultural work.

The Chinese calendar – very much like the Hebrew calendar- is a combination of the solar and lunar calendars in that it strives to have its years concur with the tropical year and its months coincide with the synodic months. It is not surprising that a few similarities exist between the Chinese and the Hebrew calendar.

For instance, an average year has 12 months, a leap year has 13 months. An ordinary year has 353, 354, or 355 days, a leap year has 383, 384, or 385 days. When working out what a Chinese year will be like, one needs to make a number of astronomical calculations.

First of all, you have to determine the dates for the new moons. In these cases, a new Moon is the completely black Moon (that is to say, when the Moon is in conjunction with the Sun), not the first visible crescent, as is used by the Islamic and Hebrew calendars. The date of a new moon is then the first day of a new month.

The reason why the majority of countries which had their own calendars had to dump them in favour of the Western, Julian calendar that we use today, is business. First the British and then the Americans ran international business and they used the Gregorian calendar. Anyone who sought to work with them had to follow suit. This is why national policy often varies from local custom in Third World countries.

The government desires to trade on the International markets, but the ordinary family in the country can not. So, the government adopted the Gregorian calendar but the people only pay lip service to it. I live in Thailand and people here do not even use the 24 hour day divided into two halves. Their day has four sections of six hours each and the first part starts at 6AM, not midnight. Therefore, they have four 4 o’clocks a day, for example but no 7 o’clocks. They are also 543 years ahead of us, although this is more common, for instance in Muslim countries.

2] Employ good, compassionate personnel. A fully trained chauffeur is a necessity, but a military style driver can add to your firm’s image.

3] It is a good idea to offer different packages or elements that a couple can use to build a package. So, you could offer transport from the bride’s house to the church as one element. From the church to the restaurant as another element and from there to the chosen hotel, the airport or the railway station, as another element.

4] Make certain that your clients know exactly how long they have exclusive use of the vehicles for. This is useful for them, so that they know exactly how long they have to take photos, eat or chat.

Transport plays a huge and vital part in any wedding day celebrations. In fact, poorly timed or scruffy transportation can ruin a wedding day. If you let that happen, your firm’s standing will suffer badly, particularly in a town or village. You will need a high sense of responsibility; reliable, well-trained, sensitive staff and high quality cars that look the part. I was looking through a history book and it was going on about memorable events of ten years ago, but I had forgotten most of them. I have picked out some of the events of exactly ten years ago this month – January, in a word. So here are a few things that you may or probably will not remember from January 2000.

1 – on his first day as acting president, Vladimir Putin departed to visit Russian troops in Chechnya.

4 – President Clinton recommends Alan Greenspan to a fourth four year term as Chairman of the Federal Reserve.

5 – President Clinton rules that Elian Gonzalez, a six year old Cuban boy who survived the capsizing of a refugee boat, should be returned to his father in Cuba.

6 – much of Miami is shut down by hundreds of Cuban-Americans protesting the Gonzalez decision. – the S.E.C reports that most partners of Price, Waterhouse, Coopers, the world’s largest accounting firm, violated regulations requiring that they may not hold stock in firms that they audit. Five partners were fired.

7 – Vice Pres. Al Gore back-tracks on his assurance to ensure that all new appointees to the Joint Chiefs of Staff were sympathetic to permitting gays to serve openly in the military.

8 – AOL announces a merger with Time Warner for $165 billion: the world’s biggest ever.

11 – the British government rules that General Pinochet is medically unfit to stand trial for suspected crimes against humanity in Chile during his presidency.

13 – executives at the nation’s leading drugs companies say they want to work with Clinton to institute Medicare coverage for prescription drugs this year.

No More Marijuana Prosecutions In The City Of Seattle

If you live in Seattle and have been hiding under a rock (or aren’t a Seattle criminal attorney like me) you probably haven’t heard the good news. The city will no longer be prosecuting marijuana possession cases. Officially. Like cases are being dismissed right now. Is this good or bad? Read on to find out.

Let’s not get too far without calming the fears of all you dooms day prophesiers out there. Drug czars will still be prosecuted. People that have pounds and pounds of pot will still be prosecuted. The people that won’t be prosecuted will be the college kid that gets caught with a joint. Rest easy.

One potential consequence to this new direction is the dissemination of pot all over the city of Seattle. Worst case scenario type of people now envision people smoking a joint while they are walking down the street, when they step out to take a “smoke” break, and any other time they darn well please. Not prosecuting it for some means it will begin to take over the city.

This scenario, if really thought through, is unlikely. First, marijuana is so widely used throughout the U.S. that the only thing this will do is save college kids from getting busted with a joint out on the street. In other words, it will save stupid people from having to deal with the hassle of a drug possession charge.

A bad effect that may be felt by some is in their pocket book. For some criminal attorneys in Seattle the misdemeanor marijuana possession case is a cash cow. They are relatively straight forward, have some interesting issues, and because of that demand a fee that will make anyone rich, if you can get enough of them. Getting zero of them, however, is not good for the bank balance.

Another consequence for us attorneys, in addition to the fee, will be the fun of these cases (from a theoretical standpoint). Cops usually get the marijuana off of people by searching them illegally or using some less than straightforward tactics to search them. This makes marijuana possession cases one of the few areas where search and seizure law, and the Constitution, can be utilized. That may be gone.

At the end of the day, this is probably a great idea by the City Attorney. It will save a boat load of money for the City (at a time when they need it), it will allow the cops to work on more important things (if there is anything out there in Seattle to investigate), and it will keep people from having their lives ruined for wanting to smoke a joint.

Personal Bankruptcies Increased Last Year

In this period of increased unemployment rates and home foreclosures, personal bankruptcy rates continue to increase. Last year, it has been reported, that personal bankruptcies increased by over thirty percentage points. As more and more Americans face the financial realities brought on by our current economic situation, it is expected that bankruptcy filings will continue to increase.

Total bankruptcy filings in 2009 climbed to almost one and half million. This is more bankruptcy filings than the United States has seen since Congress revamped the bankruptcy law system in 2005. Those changes were designed with the purpose of making filings more difficult. The 2009 numbers were twice as high as the filings made two years ago.

Filings allowing debtors to liquidate assets to pay some debt and erase portions of debt, also known as Chapter 7 bankruptcies, increased by over forty percent by November. This is the latest data for such filings.

In addition to Chapter 7 increases, Chapter 13 filings are also on the rise. While Chapter 13 filings didn’t rise at the same rate as Chapter 7’s, they did increase by over 10%. These filings constitute less than 1/3 of the total filings.

Bankruptcy filing increases varied from state to state. For example, Arizona saw huge filing increases while South Carolina saw a very small increase. This demonstrates the different effect of legislation and economic factors unique to the individual states.

As the national rate of unemployment continues to loom over ten percent, many citizens that had been financially secure are now in a position that bankruptcy makes more sense. Coupled with the decreased housing market, it is no surprise that many individuals are now strongly taking filing bankruptcy into consideration.

Colorado Texting and Driving Law

On December 1st, 2009 Colorado Govenor Ritter signed into law a bill criminalizing text messaging while driving. The new law will make texting and driving a Class A driving infraction.

http://www.denverpost.com/ci_12498806 The law, which will be Colorado State Statute 42-4-239, prohibits use of cellphones for drivers under 18 years of age, and texting for any drivers. The pertinent texting language is below: A person eighteen years of age or older shall not use a wireless telephone for the purpose of engaging in text messaging or other similar forms of manual data entry or transmission while operating a motor vehicle.

The law also states that no one under the age of eighteen is allowed to use a cell phone while driving: An operator of a motor vehicle shall no be cited for a violation of subsection (3) of this section unless the operator was eighteen years of age of older and a law enforcement officer saw the operator use a wireless telephone for the purpose of purpose of engaging in text messaging or other similar forms of manual data entry or transmission. (7) The provisions of this section shall not be construed to authorize the seizure and forfeiture of a wireless telephone, unless otherwise provided by law. (8) This section does not restrict operation of an amateur radio station by a person who holds a valid amateur radio operation license issued by the Federal Communications Commission.

What Is The IRLI Working On?

The IRLI (Immigration Reform Law Institute) was founded by the Federation for American Immigration Reform (FAIR) to act as their legal arm and to work on cases that deal with the laws and regulation related to the current policies on illegal immigration in this country – particularly the cases that involves U.S. citizens that are impacted by these policies.

The stated goal of the IRLI is to work “exclusively to protect the legal rights, privileges, and property of U.S. citizens and their communities from injuries and damages caused by unlawful immigration.” In other words, they have taken the stance that illegal immigration can and does hurt American citizens, and their staff is on hand to offer legal and legislative assistance to U.S. citizens, businesses, or organizations that have, in some way, been harmed by illegal immigration.

The Federation for American Immigration Reform and the IRLI both believe that when immigration is continues in such an uncontrolled way, it can cause serious harm. The efforts of the IRLI are focused on bringing attention to the organizations and companies that are allegedly ignoring the current immigration laws.

The IRLI will get involved with many different types of cases. They often offer consultation and help to people who feel they have experienced discrimination in the work place because the employer prefers to employ illegal immigrants or because the employee voiced their opinions about the those policies. The IRLI says it doesn’t have the resources to help all the cases that request help, but they have a long history of litigation in these kinds of cases.

In the business world, IRLI focuses on representing or consulting with companies that claim to be suffering because of unfair business practices. When one company hires illegal immigrants, they will likely have an unfair advantage over the competition because they could conceivably lower their costs by a drastic amount. This can result in lost revenue, contracts, and profits for the companies that restrict themselves to hiring only U.S. citizens.

Both the IRLI and the Federation for American Immigration Reform have stated that they believe there are many problems stemming from illegal immigration, such as the declining wages and work conditions that U.S. citizens have to deal with because companies discriminate in favor of illegal immigrant labor. This is one of the things that add to the unfair business practices above.

There are other areas of litigation, too. The IRLI has pointed out problems like illegal immigrants in schools that require extra resources or special treatment, which can have an adverse effect on the experience for other students. There has also been litigation against landlords that have filled their properties with illegal immigrants and created some very poor living conditions.

The IRLI continues to serve as the legal affiliate of the Federation for American Immigration Reform at the state and local levels to challenge the laws it views as soft on illegal immigration, and the organizations or companies that try to get around the laws that are already in place.

Is America Still America Since 9/11 ?

on 9/11/01 America was scared. We had for only the 2nd time in our history, taken a real hit. This one was not a shot to the body like the one we had taken on December 7th, 1941. This was a Punch in the face. Our collective noses were bleeding. Americans were terrified. The whole country had been injured.

Then out of the smoke and darkness, our Government stepped forward and said sign this paper and We will keep you safe! Americans did not look at the paper because they were scared. Nobody thought of the consequences. All we wanted was to feel safe again. No one thought twice when President Bush signed into law The Patriot Act on October 26, 2001. The contrived acronym stands for Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act of 2001.

Eventually the smoke cleared, we wiped the blood from our noses, and the fear subsided. We started getting back into our normal routines, although the horror of 9-11 had been permanently etched upon our minds, engraved into our souls.

In 2002, George W signed the “Homeland Security Act” and created the United States Department of Homeland Security. With 9-11 behind us, freedom loving Americans began to wonder if the US Government was using 9-11 as an excuse to infringe upon our constitutional rights. People began to question if, in our state of panic, we’d given away the very rights and freedoms that make America, America! When the Act was first signed, it was suppose to “sunset” by the year 2005. Instead, George W made the Act permanent by signing it into law in 2006.

Now the Government had virtually unlimited power to do whatever it wanted under the disguise of keeping us safe! In our moment of weakness, We had willingly signed away our constitutional right to privacy, our protections against illegal search and seizure? The law is very far reaching and has been criticized as being a threat to our most basic liberties

I just think about the hundreds of thousands of lives that have been sacrificed to protect the very rights the so called “Patriot Act” has taken away. Just the thought makes me sick. It’s an affront to every American Soldier who has fought, been injured, or died to protect these rights for all American Citizens.

Soon after the Act was signed into law, we began seeing the Government use these powers to monitor United States Citizen’s phone logs, Internet traffic records, and bank and credit information. The FBI and other Government Agencies are abusing their newly expanded powers to investigate US Citizens who may or may not be involved in Criminal Activity. In fact, there is solid evidence that certain departments of the US Government and law enforcement are actually using the powers granted to them to stop terrorism to actually “fish” for criminals. As time has passed, more and more groups and individuals are coming forward to complain about the abuses and to demand an end to the US Patriot Act. The governments continued response is, they need the powers to keep us safe.

On November 5, 2009 an Army Psychiatrist opens fire on an Army base killing 12 people and wounding 31. We later learn that the government had been monitoring this person and had knowledge that he was in communication with known terrorists, yet they elected to do nothing.

On December 25th 2009, a Man boarded a plane heading to Detroit tries to ignite a bomb. Luckily, he was stopped by passengers. Again, the Patriot Act did not ensure our safety.

Since the Patriot Act was signed into law, it’s obvious that even though We have given up our freedoms in the name of Safety, nothing had changed. We are no safer then we were on September 10th 2001. All that has Changed is we’ve lost the basic Freedoms guaranteed by the United States Constitution.

Today, it appears that the US Government is using the US Patriot Act as a way to ferret out would be criminals, but what about tomorrow? Since 2001, this great nation has been in constant “Crisis”. We had the Financial Crisis, Housing Crisis, Credit Crisis, and we are now in a Health Care Crisis. Seems like there is nothing better than a good Crisis to keep Americans from thinking about De-Industrialization, Inflation, the rise in fuel prices, Joblessness, and the coming consequences of our tremendous debt.

Does anyone remember the Terrorism threat of the late 60’s & 70’s? What about the Civil Rights Activists and Anti-War Activists? I bet if the Government had the technology and the powers they have today, they could have nipped those movements in the bud.

Has anyone ever seen a Homeland Security truck in their neighborhood? You know, the ones with about 20 antennas on them. Do you think there is a possibility that they are driving around your neighborhood eaves dropping on you and your neighbors conversations? Better watch what you say. You wouldn’t want them coming down on you for being some anti government zealot or terrorist for saying what you really think. I wouldn’t want to see you get arrested because you we’re planning on attending a “Tea Party”.

How many rights do we have to lose? How far will we watch this once great Nation fall until we finally say enough? We’re being swindled out of our Children’s futures by the Global Corporations and a corrupt US Government. When do we start to say enough is enough? The time has come for all Americans to stand up for the freedoms and rights that our forefathers fought for and many true Patriots died for. The simple truth is we are stronger and safer as a Free America then We will ever be as a Government/Corporate Controlled America !!!
